Let Us Organize Ourselves More

It was wonderful to see all of you at St. Paul Pasig this morning. Within the span of just six days, we were able to pull together various groups and we counted about 2000+ availing planholders.

We will soon post the schools that were part of the PPI program. The PEP Coalition, being MetroManila based, is better positioned to interact directly with PPI and the rest of the YGC entities. But we should try to establish links already with non-Metro Manila aggrieved planholders and encourage them to start establishing different chapters that can coordinate with us.

Other groups can always identify themselves through the email pacificnoplan@yahoo.com and we will get in touch. While it is still a tough battle ahead of us, at least we feel less confused and lost today as compared to last week.

POWER TO THE PEOPLE AND LET US BE VIGILANT UNTIL VICTORY IS OURS!!!

HA HA HA HA HA Nadinig niyo ba yung pobreng abogada ng PPI sa TV kanina? Naghahanda raw sila ng package na makukuha ng planholders na mas maaga kaysa 2010. Akala niyo ba e mabibili niyo ang mga kaluluwa at prisipyo namin? Ang ipinangako niyong pang enroll taon taon lamang po ang aming tatanggapin. Gusto niyo nanaman gamitin ang kahirapan namin para makapaghain nanaman kayo ng nakakaawa at katawatawang panlilinlang.
Kaya nga po halos di ako kumain ng tanghalian sa opisina nang 5 taon habang hinuhulugan ko ang educational plan, ay para makapagtapos ang aking anak sa maayos na paaralan, at hindi siya matulad sa akin na hindi nakapagtapos dahil sa kahirapan. The suggested payment scheme of Pacific Plans seems very irregular. At this point, as it is in the hands of the court, only the court can decide on the repayment scheme, assuming that our plea for dismissal be denied. By getting planholders to settle at this point is tantamount to contempt of court.

Let us not be fooled by these people and show that it is not only MONEY that we are after but the principle of proving that what they did was UNETHICAL, INJUSTICE and INHUMAN. We just have to keep our desire and commitment to fight keep burning.

Kudos to the organizers of yesterday's meeting at St. Paul! And to the 2000plus-strong dedicated, loving and concerned co-parents who, like me, were moved primarily by LOVE OF OUR CHILDREN, STRONG MORAL COMMITMENT TO INTEGRITY AND JUSTICE and who took the pains to be there - MABUHAY TAYONG LAHAT!!!

The organizers were well prepared with appropriate handouts/forms and handled the open forum very professionally so that issues relevant to the entire body rather than to individuals were brought to fore. I am so proud to see parents of all walks of life and profession there!

I had to leave early and could not join any committee meeting then but if you could post the committees and brief description of what each one is to do, I am ready to join and surely will others who missed the meeting due to prior commitments.

As long as we continue the fight for justice TOGETHER, we Davids can go against the GOLIATH!!!! Allow me to quote from a favorite book of our children, Harry Potter. In Book 1, Professor Dumbledore tells Harry (after he defeated Quirrell, the servant of Voldemort, his evil arch enemy), "If there is one thing Voldemort cannot understand, it is LOVE. He didn't realize that love as powerful as your mother's love for you leaves its own mark...Quirrell, full of hatred, greed and ambition, sharing his soul with Voldemort, could not touch you for this reason. It was agony to touch a person marked by something so good."

Do the Yuchengcos understand LOVE for our children? They dont realize that love for our children will leave a mark that burns in our hearts and will energize us to continue the fight to see that our children get the good education we worked hard for....Their greed and ambition will NOT be able to touch us parents. It will be AGONY for them to come up against people who are marked by good.

confine ourselves to the national dailies b/c they are bound to be
expensive. If anyone is familiar with Village Voice, you would know
that these editions are distributed in the exclusive villages in Metro
Manila, as well as in upscale commercial establishments. Now I could
be wrong but I'm assuming the ad rate of Village Voice is cheaper.
And with its circulation, it is bound to be read by people within the
same social circle as the Yuchengco's.

I was at the meeting last Saturday and I'm really proud of the turnout. But I have little problem and was wondering if someone would be kind enough to help me out and shed some light on this matter.

I am a planholder of two educational plans (fully paid), one for college and another for grade school. The college plan still has 4 availments left, while the grade school plan has 5.The Pacific Plan company claims that I am entitled to receive the unpaid portion of those plans in 2010. The thing is, I also purchased a Pacific Memorial Plan. I have been paying that memorial plan monthly since June 2003 up to March 2005 (a total of 22 months). So far, I have paid about half of the pre-need price. They have moved that plan into the LifeTime company and have informed me that I can still continue paying for it monthly.

Frankly, I have lost faith in the Yuchengco Group of Companies and have no choice but to use the money I’ve set aside for that plan into better use (like tuition fees). And I really don’t feel like giving them more money when they still have some of the money from my two educational plans. However, If I stop the payments, I get nothing. I was wondering if it I could tell them to transfer some of the money they plan to pay me in 2010 to my memorial plan so that it would be fully paid already… Is that possible?

In relation to the previous note, I don't think that PPI can transfer to LPI the money to be paid in 2010.

They can always tell you to sell the fixed value plan they will replace your traditional plan with and use the proceeds to pay for your memerial plan. However, you will get even less than the 7% return they are promising. More importantaly, you will be agreeing to receive much less than what you really deserve and letting them "get away with murder".

For availing planholders who will still be getting their checks:

1. You SHOULD NOT surrender your ORIGINAL Certificate of Full Payment to Pacific Plans. You just need to show this to them.

2. When you sign the CHECK VOUCHER, indicate that you are receiving the payment UNDER PROTEST.

3. Do not sign any waiver or any other document.

The cycle will never end. We MUST watch closely...

We can't wait for 2010. The Yuchengco group should lived up to their promises in paying for the tuition fees of all planholders.

As emphasized in the Saturday meeting, we should focus on organizing our comments against the court's stay order as well as on activities that will publicize the injustice done by the Yuchengcos to add pressure to the court.

I suggest that the website admin organize the topics so that individuals who have bright ideas can give inputs depending on their expertise. Not all can formally join the committees (media, finance, legal, logistics, etc.)but all are willing to help thru their ideas.

For example, if I have an idea on what we should comment to the court or even to other interested parties (eg. Senate, Congress, etc.) that relates to finance / actuarial matters, then I go to the finance / actuarial thread so that the working committee on finance won't have a hard time looking over all the comments that relates to other issues (eg. media, legal). This way of organizing will also give us planholders more confidence that our ideas will not get lost or might be overlooked.

For starters, the topics can include 1). finance / actuarial, 2). media / communications, 3). legal matters, 4). donations / discounts for supplies or services. There could be other topics that you can think of later.

I don't think proposing to pay 7% interest per annum is justified in lieu of PPI paying the actual tuition at the time of availment. In the first place, the planholders purchased the traditional plan bec. of its contract provision that it will shoulder for the actual tuition fee once the plan matures and NOT because of the fixed interest they are proposing now.
Since this is the provision in the policy contract PPI and the other party's (planholders) earlier agreed upon, I believe PPI's changing the provision without the planholders consent is clearly a violation of the planholder's rights. They should not reason out that they were not able to anticipate the deregulation in tuition fees. When an employed person secures a loan from the bank and suddenly becomes unemployed for whatever reason and can no longer pay for his loan, can he tell the bank to lessen or free him from his obligation because he is no longer capable of paying his amortization? Of course Not! Because he is still tied up with his original contract agreement with the bank and he has to pay his obligation even this kills him! He cannot change the provision of his loan amortization without the bank's approval.
Similarly, this should also be the case between PPI and its planholders. PPI cannot dictate what is convenient for them without the planholder's consent because in the first place, this is not what was agreed upon in the educational policy contract which made the planholders purchase the educational plan.
A contract is a contract. It should be enforced even at the hurt of one of the contracting parties.

I attended the meeting last Saturday and boy, if we will all attend the Court Hearing then that would be a SHOW OF FORCE.

It is true that our COMMON ENEMY is the YUCHENGCO Group BUT you had forgotten that the Yuchengcos would not have succeeded without the help of their accomplices - JUDGE of RTC Makati and SEC.

The Lady Emcee told us that "WE DON'T WANT ADDITIONAL ENEMIES" that's true! BUT it was very CLEAR that day that ATTY. GUEVARRA of SEC, either HE IS INCOMPETENT or HE IS TRYING TO HIDE SOMTHING and NOT BEING TRUE TO US!

He kept on saying that "IT IS UNFORTUNATE THAT HE DIDN'T KNOW" ot "IT IS UNFORTUNATE THAT HE HAD NOT GOTTEN ANY ANSWER YET FROM HIS OWN PEER or STAFF" Ano ba sya? He was introduced as HEAD of the COMPLIANCE!!!! eh! papano nakalusot and Time LIfe was incorporated.

It only shows that NATUTULOG SILANG LAHAT SA PANSITAN!!!!!

Then sasabihin sa atin ng LADY EMCEE na "HE IS A FRIEND", if he is a friend then he should be TRUE to us PERIOD!!!!

Ms. LADY EMCEE, when you asked us to attend the meeting and gave us the chance to talk, YOU NO LONGER HAVE THE RIGHT TO STOP PEOPLE FROM SAYING WHAT THEY WANT TO SAY!!! LET SEC/ATTY GUEVARRA TO FEND HIMSELF!!!

ONE PROOF that shows that Atty Guevarra was not OKAY was when HE SAID : "WE WILL BRING THEM TO COURT AND CHARGED THEM CRIMINALLY" but HE DIDN'T SAY THAT WE CAN ONLY DO THAT AS INDIVIDUALS and NOT as a GROUP or COALITION or as an ASSOCIATION. THIS WAS LATER MENTIONED BY THE VOLUNTEER LAWYER.

There's a Lady, the last one who spoke and said: WE CANNOT RELY ON THE CONGRESSMEN and SENATORS!!! WE HAVE TO FEND FOR OURSELVES!!! That's true and that and so I say WE CAN NOT RELY ON SEC!!! WE CAN NOT TRUST ATTY GUEVARRA!!! If he is really on our side, He better get all the informations and RESIGN from OFFICE and DEFEND US!

Sorry Guys I was just very very frustrated that Saturday morning on how Atty Guevarra answered the questions reaised and how the LADY EMCEE immediately came to the rescue everytime SEC is being hit by the people.

Section XV: FORTUITIOUS EVENTS/ IMPOSSIBILITY

PLANHOLDER agrees that PACIFIC shall not be liable for any inconvenience,loss, damage or delay that may be sustained by the PLANHOLDER and/or SCHOLAR resulting from fire, earthquake, war or civil disturbances, extraordinary economic upheaval, strikes or any labor disputes, acts of God, government legislation or regulation , or such other matter or conditions that are beyond the control of PACIFIC in connection with the implementation of its obligation under this Agreement. PACIFIC however, agrees to pay to PLANHOLDER upon written request the plan termination value stated in SECTION XIII.

I will check my policy contract when I get home but if this were true, then this definitely weakens our case. Our best option is to appeal to the Yuchengcos or whoever the owners are now, to make it less painful for us. However, with all the badgering and sending of the hitmen to the Yuchengcos (look at other posts), this will become unlikely as well. - LOST AND HELPLESS

The phrase "government legislation or regulation" is a matter of interpretation.

If there is a legal question, the court will consider among other things the intent of the said clause.

The government did not ban nor rule that pre-need plans, much less traditional plans are illegal. No legislation was ever passed rendering the pre-need business illegal.

Who will be the final arbiter?

What say our lawyers?

We should not even argue with them on the force majeure issue. Our position is that Pacific Plans is using that clause as a convenient exit for failed and mismanaged portfolio investments.

Has Philam gone under because of the same deregulation? No.

Pacific Plans cannot fulfill it's obligations because it mismanaged it's portfolio. SEC should be able to prove that the company and it's owners weaseled their way out by using technicalities when in fact they scuttled their very own company after mismanaging the trust fund.

Why did they choose to leave the NAPOCOR assets as part of the skeletal remains of Pacific Plans isntead of more liquid blue chip assets? Why not other portfolios? Why not San Miguel and PLDT shares? Why not prime real estate?

We should not argue by proving that there was no force majeure. We argue on the contractual obligation and mismanagement of the company.

I don't think there is any regulation banning pre-need plan per se, but the underlying "core" of every fixed value plan is the 10% maximum hike. Without this, the whole fixed value plan industry dies. My question is how come the government did not regulate the industry after lifting the tuition fee hike ceilings?

I hope that my statement is not misinterpreted as a defense for the SEC as I too am a victim of the PPI fiasco, but putting the heat on Atty. Guevara of the SEC Compliance Division is not fair to the person. FYI, Atty. Guevara is new to the SEC having assumed the post only during the 3rd quarter of 2004 replacing Atty. Tomas Syquia, he has barely warmed his seat when this incident happened. I know Atty. Guevara personally and I can vouch for his sincerity. Let us give him a chance to prove himself.

So the government deregulates. The agreement never sipulated a tuition fee hike of more than 10% by schools voids the plan.

I agreee that this is a matter of interpretation by the courts.

If this is valid then the courts, by jurisprudence would give each and every pre-need plan company a way out of a contractual obligation.

Tell that to Joey Cuisia of Philam plans.

Umutang ang Pacific Plans sa RCBC ng 76.4million DOLLARS, tapos BUMILI NG NAPOCOR BONDS na may halagang 146Million dollars, pero ang kolateral na ibinigay sa RCBC ay Napocor bonds din na may halagang 249million Dollars. makikita ito sa pahina 12 at 13 ng SEC filings ng pacific palns nuong 2003.

Bakit 50million dollars na lang ang binabangit ng pacific plans sa 2010?

Sa laki ng interes na ibinabayad ng pacific plans (dolyares ang utang, dolyares ang bayad!)sa RCBC, halatang dehadong dehado ang mga planholders at iskolar ng pacific plans!! Mapawalang halaga man ang mga napocor bonds na ito, hindi malulugi ang RCBC dito!

Walang matitira, kapag bumagsag ang halaga ng piso, pagdating ng 2010!!

Dapat talaga makulong LAHAT ng mga opisyales ng Pacific plans!

Just some chismis that I'd like to share from a very , very reliable source....Helen Dee, daughter of Al Yuchengco, was seen having dinner with Mike Enriquez ( of Channel 7 ) at Mandarin's Paseo Uno the night following their "proclamation" of not honoring all existing PEP plans....must have discussed some very , very, very important matters. !?!?!?!?!

If PPI bought Napocor bonds with $76.4 million borrowed from RCBC, then PPI would have to pay RCBC back for the loan. If the bonds were valued at $249 million and there is only $50 million left with the trust fund now, what happened to the difference? Were the bonds sold at a huge loss at the expense of the planholders to pay RCBC?

Rich or poor, we have to unite to see to it that no tycoons will ever repeat what the Yuchengco's are attempting to do to us now. Using the media, print, tv to cover up their greediness. Do you notice the big Ads lately of Malayan Insurance, RCBC,Mapua and other subsidiaries of the Yuchengco Group of Companies in major newspapers like Phil Inquirer? Thus, you read columnists advising planholders to be grateful for the 7% interest Pacific Plan is offering in 2010. Do they think Filipinos are stupid?
We didn't buy Peso Bond, we bought Educational Plans. We want the Educational Plan to serve its purpose. Helen and Vivian, how do you face God on judgement day? How many lives have you shattered? More tragedies will happen as a result of your greediness and betrayal. You better shape up and give the planholders their due or face unimaginable consequences.

I recall in the St Paul's meeting, someone suggested that we meet in front of the Makati RTC on Wednesday, 7AM. From there, we will march to the RCBC towers in show of protest. All to wear white shirts with a black band on our arms. It seemed that many planholders present agreed to this plan. Is this still pushing-thru? There seems to be no comment on this.

Just got back from the online version of Philippine Star, where I read Dong Puno's comment on Pacific Plans. I assume it is the same as what came out on print.

I don't see anything wrong with what he wrote. He covered most of the issues we have been raising here. Which of his numbers is out of whack? Is it the P300 million he mentioned in his last paragraph? If that was conjecture, so what? It's anybody's guess how much would be needed to set things right for those availing this year. My own guess is that it's closer to P billion.

But that number is not so important now. It's the media mileage that we're generating that's important. We need the exposure. I, for one, am thankful that Dong Puno outlined the problem as well as he did. Let's hope there are similar comments from other columnists in the other major newspapers. If you guys know other columnists, let them know about this fiasco and ask them to comment also. The more, the merrier.

This is vital information: Judge Romeo F. Barza used to be an Associate of "The Firm" They are Fraternity Brothers of Villaraza Angangco, --Sigma Rhoans, and is batch 75 UP Law. It's no surprise then that decisions were done fast and in favor of PPI.

In page B-6 of today's issue of Philippine Star, Pacific Plans advertised 1/4 page notice to PPI Traditional Education Planholders. Pls. note my comments:

Item 1 said PPI shal NOT exercise its rights under the fortuitous event clause of the contract. REASON: They already shielded themselves from full payment of their Obligation by the Stay Order and possibility of Rehabilitation penned by Judge Barza.... who by the way is a former Associate of lawyers handling this case for PPI.

IN same ad, they said "PPI paid all tuition benefits until April 13, 2005. I agree with this, infact their business move to discontinue traditional educ plan and intro fixed value educ plan worked so well they were able to pay all claims, honor their Obligation to pay tution fees at any cost for thirteen(13) years since Pres. Ramos lifted tuition fee increase cap last 1992. Last Sept 17, 2004, however, YGC's PPI transferred businesses of pacific plans (except traditonal educ plan) to LIFETIME PLANS INC. after seven months since the opening of LIFETIME PLANS, PACIFIC PLANS INC. drained of blood and the Yuchengco's declared it ready for rehabilitation. Unconfirmed but worth looking into: LIFETIME PLANS INC. earned P600M on its first year of operations.

trurh to tell, i have not read the contract between planholder and PPI. but what confuses me (from what i watched in dong puno last night) were the different clauses in contention.
winnie pointed out a clause saying to the effect that NO MATTER WHAT HAPPENS, PPI WILL ASSURE OUR CHILDREN OF AN EDUCATION>
but in contrary, the lawyer of PPI points to that section regarding govt. deregulation.
my question is, arent these two clauses conflicting with each other? if so, then it will be up to the judge to decide whether which clause is more important.

Forget the clauses, forget what winnie said, and what PPI lawyer said. The fact is when Rehabilitation is granted, Pacific Plan is protected by law not to pay
any obligation, or debt, including their Obligation to pay full tuition fee of our children... they "(PPI) is willin g to swap the traditional plans with fixed value plan" - see page B-6 of Phil Star April 29, 2005 issue. For Freshman enrolling this JUne, 2005 in a non-exclusive school, we're talking of P280,000 at today's pries vs. P80,000 in 2010.

attended the 1st meeting at st paul's and have been updating myself through this and other sites...i notice that there seems to be a lag in the organization... no leaders are coming forward to get people organized.... For example, i attended a function over the weekend, talked to a couple of friends and relatives and nobody seems to know what's going on after the 1st meeting. Among those of us present during the occasion, we probably have close to 50 plans...the coalition board please come up with a definite plan whether school based or otherwise and post it at this or other site... what i saw in the other site was a suggestion on how to get organized....

To the previous poster, the finance and legal teams are doing a lot of research and meetings to strategize. Rest assured that the so-called "leaders" are working on things that just could not be published. The date of May 13 (May 15 being Sunday) is still in everybody's mind and given importance.

The "leaders" have likewise been coordinating with schools to be informed of what has been happening. I suggest that you do the same thing with your school, if not yet done. You can send a note to pacificnoplan@yahoo.com if you need the coalition "leaders" to meet up with the planholders in your school.

If you have submitted your membership form during the 1st general meeting, this will suffice for now.
