Pacific Planholders Unite !!!

A Message from our adhoc leader, WMB

We will have a General Assembly meeting on Saturday morning 23 April 2005. We have invited a panel of lawyers to answer all our queries re legal options open to us. We shall send out details re time and venue by Wednesday at the latest.


Please pass this message on, by text, by phone and whatever means available to other Planholders. It is also important that we are able to link up with other groups who are looking for help.

check investments made by pacific plans all the way back thru angel rosales rcbc trust head 1996, all palpak. but sold pldt at 1000 bought back around 300 - 400 made at least 400 million,.what returns are they talking about. why blame sec. people bought bec. yuchengcos were supposed to have a deep pocket and rcbc can help what happened? why cant they support why throw in the towel

when the agents of pacific plan were selling the educational plan, we were told that pppi is stable because it is the yuchengco group who are behind the company. that is one of the reasons why they were able to convince me to get various educational plans for my 3 children. Now they are telling us that the yuchengcos are no longer part of ppi? very deceiving people!!!!!!!!!!!!!!!!!!!!!

from an agent's point of view....
When we were selling the plans and the company were raking lots of money, we were assured of the management adherance to the contract originally signed by the planholders.

For several years there was no problem on the manner pacific plans was paying the benefits of the scholars however few years later we observed so many changes were implemented on the traditional plan by the management. Some of them were:
1) Some schools like ust, mapua, ama etc. were upgraded to exclusive 2 schools surprising planholders who got non-exclusive plans;
2) Transfer of plans to another scholar were deferred for 5 years meaning transferred plan could still be use 5 years after.
3) Deferred Plans (Plans with no declared scholar) before could be assigned by the planholder to any scholar and could be use anytime but a year ago deferred plans could no longer be assigned to any scholar with no relationship to the planholder and that it could still be use 5 years later. However, if allowed to be used by a son or daughter of the planholder only 70% of the benefits due is given by the management.
4) Transfer and assignment of plans were stop February this year.

Despite so many changes, we followed and tried to explain to our planholders. Then came Lifetime Plans, Inc., we were told that fixed value plans will be assumed by Lifetime Plans, Inc. and the traditional plans were still be under Pacific Plans, Inc. but we were assured that the trust fund for the traditional plan were sufficient enough to cover future availments until all the plans are fully availed.

Lately, the transfer of the availment office to Kamagong, For us agents who are servicing and assisting our planholders in their availments, it was indeed time consuming (also pain in the pocket) going to and pro kamagong and grepalife bldg. Direct payment to schools were stopped so checks have to be picked up at the Kamagong Office.

Then came the Stay Order announcement for the "rehabilitation scheme" last April 13, 2004. Almost all of us were surprised and schocked. On the previous availments we could get the checks of our planholders thru an authorization letter and a xerox of the ID of the planholder. After the Stay Order, checks could only be picked up by the planholder or a representative with a Special Power of Attorney. With the so many requirementss agents have no other alternative but asked our planholders to personally pick up the check.

We are not only agents but also planholders and the premiums we paid for the plans of our children were hard earned money. We were bombarded with questions and queries by our planholders but WE TOO were deserted by the management.

AM CALLING ALL SALES PEOPLE OF LIFETIME PLANS THAT LET US TOO UNITE.... HAYAAN NATING SILA ANG MAGBENTA!!!! TAMA NA SOBRA NA!!!

i went to the grepalife office and met with my agent yesterday morning hoping to get concrete answers as to what happened and what's next. i even talked to her boss but everybody there seems to be at a loss too.

after our meeting, i proceeded to the kamagong office at around 1pm.(how convenient that they moved it far from the main office this year!they already knew what was coming!i got hold of the waiting list...i was already going to be number 417. they made us stand under the scorching heat, i just wanted to scream when i heard the guard calling out numbers...nasa 150 something pa lang sila!

i didn't stick around anymore to wait for my turn...which i truly doubt will never come within the day...i just got hold of the yellow pep coalition flyers and left feeling that the only way we can make our voices heard is to work together in making PACIFIC PLANS give the education our children deserve TODAY and not in 2010!

we as planholders of PPI should unite! i can't beleive that the Yuchengcos will let us fail especially the Ambassador whose famous line is "Integrity in the Business". YGC said, that we at "YGC together as one can do more for you" or "YGC AS ONE"! Where are those famous lines of YGC! How can we trust Yuchengcos now! Are we still goin to patronize their products?! Unless they give what is due us, I can't trust them anymore!

i guess we planholders and plan agents should all unite to fight this monster trying to "kill" our dreams of giving our children good education! How insensitive for PPI and degrading for us planholders to be getting OUR money under scourching heat in a very small office in nowhereland! i was told that their lease for their current office is only for 6 months so i hope they don't disappear again to God knows where with our money! we have removed all our placements in YGC banks, even how small it is, just to be sure that our investments do not get lost this time! i suggest we let YGC group feel our strength and unite!

The chain on events leading to the receivership clearly show that the Yuchengcos were planning this for a long time. The fact that they transferred non open-ended plans to another Yuchengco pre-need company Lifetime Plans is evidence of their intent to defraud the remaining plan holders.

We should also consider how we can get the employees of the Yuchengco group of companies involved in this collective effort to oppose the actions of Pacific Plans. Afterall, it is only logical to assume that a lot of the agrieved planholders are these employees themselves since the plans were initially offered to them, some even via salary deductions. They may even be our best source of information. We have to be cognizant, however, that while these employees feel agrieved, they also fear losing their jobs if they oppose the Yuchengcos.

The impending demise of Pacific Plans,Inc. is wrought with fraud and treachery.

Is it true that the more than 300,000 profitable fixed plans were transferred to Litetime Plans, Inc., leaving behind the 34,000 traditional plans to collapse with Pacific? SEC has a lot of explaining to do.

I thought the Yuchencos, Virata, Navarro, Gloria tan climaco, et al, are shades above the Sobrepenas. Of course, the Yuchengcos only copied the educational plan concept introduced by the old man Sobrepena after he retired from Pacific. Now the perfect copycat that the Yuchengcos are, they are now using the avenue paved by CAP in order to get out of their commitment. At least the Sobrepenas are more honorable in admitting their mistakes and in trying to salvage the company. The Yuchencos and company are the worst kind! They and their experts are hoodlums in dark suits. No different from the thief who comes in the dead of the night. In other words, mga AKYAT BAHAY!

You're right. The non-trad plans of PPI were spinned off to the new company, Lifetime Plans, Inc. For what reason, we don't know and that is what they have to explain to us.

We need corporate lawyers, CPAs, financial analysts and other experts to review and investigate this "manuever" so the truth and irregularities could be uncovered. I'm sure this will "open a can of worms".

What the Yuchengco's did to Pacific educational Plans is the height of treachery and outright thievery!!! Mahiya naman kayo. We paid for our children's educational plans with honest blood,sweat and tears.There is no excuse for such corporate treachery and thievery.Let us boycott all products and services of YGC!!!
To the SEC and other related government regulatory agencies do not turn a blind eye on our predicament.

I have several questions here, what would happen to the planholders who took the last checke they could from Pacific Plans? In my case, I took the P35000 they provided as part of the"assistance" they will provide. Would I still be able to sue them if I can? I did not sign any quit claim or anything when I got the check.

I'm sure there are others who took it, considering that you were expecting to get money for your child's education, that amount is still a big help than nothing at all.

I AM AN ANGRY PLANHOLDER!!

I suggest that the lawyers look closely at the latest Financial Statements/SEC documents that Pacific Plan submitted last 2003.

Issues:

1. Why is it that Joaquin Cunanan & Company, the external auditors, was able to get away with submitting a QUALIFIED Comment of the FS to the SEC? Imagine the SEC getting that report from Pacific Plans, where the external auditor states that they have not looked into the TRUST FUND as well as the ACTUARIAL RESERVE LIABILITY? These are the two most important (and biggest) items in the preneed chart of accounts!! Useless Joaquin Cunanan, and NEGLIGENT SEC!!

2. Why is it that Joaquin Cunanan & Company also mentioned in the report (page 17) that the planholder database have not been verified? Could it be that Pacific Plans have been OVERSELLING plans to finance their ever-expanding BUSINESS EMPIRE? Diba bawal ang overselling? At dapat may sanctions ang overselling (stop selling new plans), parang sa CAP?

3. Why is it that SEC allowed a trust-fund deficient company Pacific Plans to transfer its trust fund assets to Lifetime Plans? Deficiencies should be addressed first, before doing any corporate restructuring!! This precedent is dangerous!!

4. Rizalino Navarro, former chairman of SGV, should be made to explain why they chose Joaquin Cunanan to be the external auditor. Is it because of delicadeza? Or is it because he did NOTHING when he saw the preneed TIMEBOMB waiting to explode, as early as 1999? What the fuck happened to CORPORATE GOVERNANCE, Navarro, Virata, Singson? Fat-asses!!

5. Why did the SEC allow Pacific Plans to invest 70% of its trust fund to the bankrupt/financially bleeding NAPOCOR BONDS? Whatever happened to the investing limits per asset class that Preneed companies have to comply with? Dapat itinago ko nalang yung pera ko sa ilalim ng kama ko.....

6. Is it true that the Yuchengcos are SO POWERFUL in the SEC that complaints are "fixed" with generous amounts of money at lower levels at SEC? Paging previous SEC chairman/woman!!

7. Is it true that there were officers in the company who received as much as 5 MILLION PESOS in "PERFORMANCE BONUSES" during the heydays of Pacific Plans?

8. How true that there is a 50million peso PR fund to silence media?

9. IS IT TRUE THAT LIFETIME PLANS MADE 900MILLION PESOS LAST YEAR? ATTENTION B.I.R.!! DID THEY PAY THE RIGHT TAXES? DAPAT MAKULONG SILA SA TAX EVASION!! Paging Richard Gomez, pruweba ito ng FAVORITISM ng Gobyerno natin!

DAPAT PO MAY MGA MAKULONG DITO!!

BLOOD MONEY ITO!!

KAPAG WALANG GINAWA SI PRES. GMA, CIVIL DISOBEDIENCE TAYONG LAHAT!!

Regarding the sexual prowess of one of the officers of Pacific Plans is not the issue here. For all you know, he will be jailed for statutory rape one of these days. Better still, he might come down with AIDS.

Like you, I am an aggrieved plan holder.

At night,when my 2 sons are asleep I look at them and think about their future.I worry about what's in store for their generation.I worry about providing for their education because that is my responsibility as a father.

The collapse of Pacific Plans is an indication of where this country is heading- to the dogs!

i'm a single parent having been widowed since june 17, 2004. i barely make both ends being the sole bread winner. what consoled me in this state is the fully paid exclusive 2 educational plan my husband left for our only child, a son now to enter college. but with the latest development with pacific plans, i worry so much for the money to support his full college course. it is so depressing to think na baka hindi na makapag-aral ang kaisa-isa kong anak. they stripped my child of his bright future na pinagsikapang ihanda ng namayapa kong asawa mula sa kanyang pagtatrabaho bilang isang ofw. wala silang pinagkaiba sa mga hardened criminals.

Ang pikon, talo. That is a truism we are all familiar with. In this fight with the powerful THIEVES who have stolen our kids' future, we must be deliberate and methodical in getting back at them. A few ideas...

point 1. There are supposedly 35,000 of us traditional plan holders who were shortchanged by YGC. If just 50% of us gave P100 each, we can raise P1.7m which can buy several big billboard spaces on EDSA, a couple of full page ads and quite a few leaflets we can hand out to publicize how we were cheated by the crooks of YGC. Lawyers among us can screen what we will put in the billboards for any libelous materials. Admen/copywriters can do the copy that will be put out in the billboards/full page ads for maximum effect.

point 2. All these YGC people live somewhere, belong to neighborhood associations, social clubs etc. Lightning rallies/pickets near the gates of their communities or even in their front gates identifying them as the THIEVES who stole our kids' fututre so as to expose them to social pressure could produce results.again, advise from our lawyer friends on the limits of free expression would be appreciated.

point 3. handing out leaflets while walking the major malls or even in the vicinity of YGC businesses can publicize our battle and alert the people to the brutal and heartless character of the YGC.

We can not fight the YGC in an arena they control. We can not fight them on equal terms in the courts, not in media, certainly not in government (witness the inutile SEC). No matter how hard we try, we will always lose. We can only win if we go thru avenues they have no control over.

Please think about this. I am sure there are other ideas on how to get back at the THIEVES who stole our kids' future without going thru the avenues they control.

To all planholders, let's think this one through and get some realistic outcomes straight. In the off-chance that we make a big enough dent in the "corporate integrity and reputation" of the YGC group and they decide to infuse capital or extend some kind of financial support from other companies in the group to pay us what is due this year, I sincerely doubt that they will continue doing so in the coming years. In other words, there may be a possibility of a short-term palliative but after that, what? Then, also slim is the possibility of quickly winning a class suit against YGC where we'll all be awarded with generous sums to cover our educational plans and all the moral, legal, financial damage that we file claims for. Siguro naman, its also unthinkable that we, as planholders, can ever RETURN to a TRUSTING relationship with YGC again!!! In other words, wala nang balikan ito for both parties. They have no incentive to serve us well anymore while we shouldn't even think that receiving money will heal all our wounds and make us the loyal planholders that we once were. One-time lang itong labanang ito with them and that's it! So, bottomline, we need to hit them where it hurts. Hit them so that it, too, becomes a personal loss to them. What they did was economic sabotage in the individual and collective lives of Filipino families. What they deserve is an economic downfall of their own. They made this downfall happen by themselves. If we kill the Yuchengco Group by not doing business with them, it is only an effect and result of their own wrongdoing. It is like the rapist or drug dealer who knows that heinous crimes are punishable by death. In choosing to do so, the rapist or drug dealer seals his own fate. The Yuchengco group knew fullwell that "killing it planholders" is punishable by "death of its economic life". Let's simply execute the sentence. TLS

im a mother who purchased a fixed pacific plan for my daughter 3 yrs ago and my sister told me about this development with pacific plan, i havent finished paying my plan and im very confused now on whats happening to the company, can somebody enlightenement on whether i should still continue to pay for my daughters plan or just ask for a cancellation and if so will i get some of the money i invested before. I would greatly appreciate this since im out of the country and in the dark with this situation. I was hoping for a brighter future for my daughter when i purchased that plan but now ill just have to start all over again.

Does joining the egroup mean formally joining the coalition? I would like to contribute to the efforts of the coalition but I don't have a legal background. My background is finance. I hope we will be more prepared than the PP lawyers on the day of the hearing.

what's the latest news about ppi? do they still exist? i bought the plan way back 1989 when my daughter was only 0 age. she should have used it 4yrs ago and even now coz i invested 4yrs high school and 5yrs college plan. at this time of typing, my daughter is enrolling at the university for her 1st yr course, but pissing me off that the money would come from my own pocket! ridiculous. i went to a meeting held at cultural centre sometime in 2004, and was told that planhodlers can claim their checks in year 2010. true or not, i don't care. i just want my money back with interest, i should have invested my money at the bank much better. pls tell me if u hear anything about the issue.
